
JOHOR BARU Court Grants DNAA Ruling
JOHOR BARU : A senior citizen accused of slapping a man for eating in public during Ramadan has been discharged by the Magistrate’s Court, though the ruling does not amount to an acquittal (DNAA).
Magistrate A Shaarmini granted the DNAA ruling to Abdul Razak Ismail, 65, after Deputy Public Prosecutor Nur Fatihah Mohd Nizam informed the court that the Attorney General’s Chambers (AGC) had instructed the case to be discontinued and referred back to them.
This decision was made just as the court was about to determine bail conditions for the accused.
Dispute Over Guilty Plea
Earlier, the court rejected Abdul Razak’s guilty plea when he disputed the case facts despite admitting to injuring a 21-year-old man.
The charge, framed under Section 323 of the Penal Code for voluntarily causing hurt, alleges that Abdul Razak slapped the victim at a convenience store inside a shopping mall at approximately 3.45pm on Sunday (March 16).
However, he disagreed with the prosecution’s statement that the slap had left visible bruises, arguing that he did not hit the victim with enough force to cause such injuries.

Viral Videos and Police Investigation
Magistrate Shaarmini, refusing a conditional guilty plea, set the next case mention before the AGC’s instruction resulted in a DNAA ruling.
Videos of the incident, lasting 32 and 44 seconds, have since gone viral, and police confirmed that the 21-year-old victim filed a report on Sunday night. Investigations remain ongoing under Section 323 of the Penal Code.
